{"id":27151,"date":"2023-02-16T09:00:45","date_gmt":"2023-02-16T08:00:45","guid":{"rendered":"https:\/\/www.thema-med.com\/?p=27151"},"modified":"2023-02-10T15:57:28","modified_gmt":"2023-02-10T14:57:28","slug":"europa-directiva-sobre-ciberseguridad-ue-2022-2555","status":"publish","type":"post","link":"https:\/\/www.thema-med.com\/es\/2023\/02\/16\/europa-directiva-sobre-ciberseguridad-ue-2022-2555\/","title":{"rendered":"EUROPA: Directiva sobre ciberseguridad (UE) 2022\/2555"},"content":{"rendered":"<h2>Hoy en d\u00eda el tema de la ciberseguridad desempe\u00f1a un papel cada vez mayor, especialmente en \u00e1mbitos cr\u00edticos como la sanidad p\u00fablica y el sector m\u00e9dico: por este motivo, la Uni\u00f3n Europea pretende reforzar los sistemas inform\u00e1ticos para garantizar que todo el mundo pueda beneficiarse de los servicios y utilizar las herramientas digitales de forma cada vez m\u00e1s segura y fiable.<\/h2>\n<p>Desde 2020, la Comisi\u00f3n Europea y el Servicio Europeo de Acci\u00f3n Exterior (SEAE) trabajan en una <a href=\"https:\/\/digital-strategy.ec.europa.eu\/en\/policies\/cybersecurity-strategy\">estrategia de ciberseguridad de la UE<\/a> para reforzar la <strong>resiliencia de Europa frente a las ciberamenazas<\/strong>, que se adopt\u00f3 en <a href=\"https:\/\/www.consilium.europa.eu\/es\/press\/press-releases\/2021\/03\/22\/cybersecurity-council-adopts-conclusions-on-the-eu-s-cybersecurity-strategy\/\">marzo de 2021<\/a>.<\/p>\n<p>El 27 de diciembre de 2022 se public\u00f3 la <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/ES\/TXT\/PDF\/?uri=CELEX:32022L2555&amp;from=EN\">Directiva (UE) 2022\/2555 del Parlamento Europeo y del Consejo<\/a>, relativa a medidas para un elevado nivel com\u00fan de ciberseguridad en la Uni\u00f3n, que, tras su transposici\u00f3n por los Estados miembros, modificar\u00e1 el Reglamento (UE) n.\u00ba 910\/2014 y la Directiva (UE) 2018\/1972 a partir del <strong>18 de octubre de 2024<\/strong> y derogar\u00e1 la Directiva (UE) 2016\/1148 (Directiva NIS 2).<\/p>\n<p>El art\u00edculo 1 de la Directiva (UE) 2022\/2555 <strong>establece<\/strong> la obligaci\u00f3n de que los Estados Miembros adopten <strong>estrategias nacionales<\/strong> de ciberseguridad y designen o creen autoridades nacionales competentes, autoridades de gesti\u00f3n de crisis cibern\u00e9ticas, puntos de contacto \u00fanicos de seguridad (puntos de contacto \u00fanicos) y equipos de respuesta a incidentes de ciberseguridad.<\/p>\n<p>Tambi\u00e9n define las medidas de <strong>gesti\u00f3n de los riesgos<\/strong> de ciberseguridad y las obligaciones de informaci\u00f3n para las entidades que operan en sectores muy cr\u00edticos, incluido el sector m\u00e9dico, o cr\u00edticos por otros motivos, as\u00ed como las obligaciones de intercambio de <strong>informaci\u00f3n<\/strong> y notificaci\u00f3n (<strong>vigilancia<\/strong>) en materia de ciberseguridad.<\/p>\n<p>La Directiva tambi\u00e9n tiene un fuerte impacto en el <strong>sector sanitario y m\u00e9dico<\/strong>, como sector de alta criticidad seg\u00fan el anexo I Dir.2022\/2555, y se aplica a varias partes interesadas, entre ellas:<\/p>\n<ul>\n<li>Laboratorios de referencia designados por la UE para apoyar a los laboratorios nacionales (Art\u00edculo 15 Reg. (UE) 2022\/2371.<\/li>\n<li>Fabricantes de dispositivos m\u00e9dicos considerados cr\u00edticos durante una emergencia de salud p\u00fablica. La lista de productos cr\u00edticos durante una emergencia de salud p\u00fablica se establece en el art\u00edculo 22 del Reglamento (UE) 2022\/123.<\/li>\n<li>Fabricantes de dispositivos m\u00e9dicos (art\u00edculo 2, punto 1 MDR (UE) 2017\/745) y dispositivos m\u00e9dicos de diagn\u00f3stico in vitro (art\u00edculo 2, punto 2 IVDR (UE) 2017\/746), con la excepci\u00f3n de los fabricantes dispositivos m\u00e9dicos considerados cr\u00edticos durante una emergencia de salud p\u00fablica.<\/li>\n<\/ul>\n<p>El nivel de aplicaci\u00f3n de la ciberseguridad en el sector m\u00e9dico ya ha tenido un primer desarrollo con el MDR (EU) 2017\/745 y el IVDR (EU) 2017\/746, que, en su Anexo I, definen la necesidad de <strong>tratar adecuadamente los datos personales<\/strong>.
