CH REP is a physical or legal person with registered office in Switzerland acting on behalf of Medical Devices Manufacturers based outside the Swiss territory.<\/p>\n<p>&nbsp;<\/p>\n<figure class=\"wp-block-image\"><img decoding=\"async\" class=\"wp-image-19057\" src=\"https:\/\/www.thema-med.com\/wp-content\/uploads\/2021\/10\/ch-rep-rappresentante-autorizzato-mandatario-svizzera-1024x535.jpg\" alt=\"CH REP Swiss Authorised Representative medical devices\" \/><\/figure>\n<p>&nbsp;<\/p>\n<h4 class=\"wp-block-heading\"><strong>WHY IS THE CH REP FIGURE NECESSARY?<\/strong><\/h4>\n<p>&nbsp;<\/p>\n<p>The <strong>CH REP<\/strong> figure &#8211; Swiss Authorised Representative &#8211; it\u2019s necessary if Manufacturers based outside the territory wanting to market their Medical Devices in Switzerland.<\/p>\n<p>&nbsp;<\/p>\n<p>In this article we will give you some information about the <strong>transitional periods<\/strong> scheduled for the <strong>CH REP nominee<\/strong> and about <strong>Swiss Authorised Representative tasks.<\/strong><\/p>\n<p>&nbsp;<\/p>\n<h2 class=\"wp-block-heading\"><strong>From when is it necessary to nominate a CH REP?<\/strong><\/h2>\n<p>&nbsp;<\/p>\n<p>Since May 26<sup>th<\/sup>, 2021, date of full application of MDR (UE) 2017\/745 in Europe, Switzerland officially became a third country for Europe and the new Swiss regulation together with the revision of <strong>Ordinance MedDO SR 812.213 <\/strong>came into effect<strong>.<\/strong><\/p>\n<p>&nbsp;<\/p>\n<p>Such ordinance requires that <strong>Swiss Manufacturers<\/strong> appoint an <strong>European Authorised<\/strong> <strong> Representative<\/strong> to export their devices in Europe and, at the same time, <strong>European Manufacturers<\/strong> need to appoint a <strong>Swiss Authorised Representative, CH REP, <\/strong>to export their products in Switzerland.<\/p>\n<p>&nbsp;<\/p>\n<p>Depending on Medical Device risk class, <strong>MedDO Article 104a<\/strong> requires different <strong>transitional periods<\/strong> and the <strong>CH REP has to be appointed<\/strong> in accordance with the following deadlines:<\/p>\n<p>&nbsp;<\/p>\n<ul class=\"wp-block-list\">\n<li><strong>By December 31<sup>st<\/sup>, 2021,<\/strong> for class III devices, class IIb implantable devices, and active implantable Medical Devices;<\/li>\n<li><strong>By March 31<sup>st<\/sup>, 2022,<\/strong> for class IIb non-implantable devices and class IIa devices;<\/li>\n<li><strong>By July 31<sup>st<\/sup>, 2022,<\/strong> for class I devices.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>MedDO <strong>Article<\/strong> <strong>51<\/strong> paragraph 5 requires the following transitional period for the Swiss Authorised Representative nominee:<\/p>\n<p>&nbsp;<\/p>\n<ul class=\"wp-block-list\">\n<li><strong>By July 31<sup>st<\/sup>, 2022,<\/strong> for systems and procedure packs.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h2 class=\"wp-block-heading\"><strong>Informative sheet on Swiss Economic Operators obligations<\/strong><\/h2>\n<p>&nbsp;<\/p>\n<p>On September 27<sup>th<\/sup>, 2021, the Regulatory Authority Swissmedic published the useful <strong><a href=\"https:\/\/www.swissmedic.ch\/swissmedic\/en\/home\/medical-devices\/market-access\/pflichten-bevollmaechtigte.html\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"\u201cInformation sheet, Obligations Economic Operators CH\u201d (si apre in una nuova scheda)\">\u201cInformation sheet, Obligations Economic Operators CH\u201d<\/a> <\/strong>to clarify some aspects about MedDO which define requirements and responsibilities for Economic Operators involved in Medical Devices supply chain.<\/p>\n<p>&nbsp;<\/p>\n<p>Specifically, the informative sheet focuses on the Swiss Authorised Representative, the Importer, the Distributor and their obligations. This document also refers to Medical Devices, their accessories, and devices with no intended medical use (mentioned in the informative sheet and defined in the Annex XVI MDR and the Annex I MedDO).RYou can find <strong>graphics and charts<\/strong> that exemplify the Authorised Representative, Importer, and Distributor obligations.<\/p>\n<p>&nbsp;<\/p>\n<p>Finally, there is some information about <strong>roles that must be visible on the devices and where they need to be indicated<\/strong> (labels, IFU, packaging).<\/p>\n<p>&nbsp;<\/p>\n<p>In this respect, we would like to remind you that Swissmedic has published on its website the <strong><a href=\"https:\/\/www.swissmedic.ch\/swissmedic\/en\/home\/medical-devices\/market-access\/ch-rep.html\" target=\"_blank\" adverse events.<\/li>\n<li>Respecting the post-market surveillance scheduled duties.<\/li>\n<li>Registering devices on Swissmedic database respecting the regulatory
