{"id":17953,"date":"2021-04-27T08:55:37","date_gmt":"2021-04-27T06:55:37","guid":{"rendered":"https:\/\/www.thema-med.com\/?p=17953"},"modified":"2023-01-24T14:59:00","modified_gmt":"2023-01-24T13:59:00","slug":"turkey-amendments-to-medical-devices-sales-advertising-regulation","status":"publish","type":"post","link":"https:\/\/www.thema-med.com\/en\/2021\/04\/27\/turkey-amendments-to-medical-devices-sales-advertising-regulation\/","title":{"rendered":"TURKEY: amendments made to the Regulation on sales, advertising and promotion of Medical Devices"},"content":{"rendered":"\n<p>Recently, the <strong>Turkish Medicine and Medical Devices Authority\n(&#8220;TITCK&#8221;) <\/strong>made amendments to the Regulation on <strong>sales<\/strong>, <strong>advertising<\/strong>\nand <strong>promotion<\/strong> <strong>of Medical Devices<\/strong>.<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/www.thema-med.com\/wp-content\/uploads\/2021\/04\/turchia-modifiche-regolamento-vendita-promozione-dispositivi-medici-1024x536.png\" alt=\"Turkey amendments made to the Regulation on sales, advertising and promotion of Medical Devices\" class=\"wp-image-17907\"\/><figcaption>Amendments made to the Regulation on sales, advertising and promotion <br>of Medical Devices<\/figcaption><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What are the main changes?<\/strong><\/h2>\n\n\n\n<p>Sales centres authorised by the Regulatory Agency to sell their Medical Devices in Turkey, must not only <strong>send data<\/strong> on their sales to the Product Tracking System, but also <strong>store<\/strong> this information.<\/p>\n\n\n\n<p>With regard to advertising, Medical Devices have been divided into three\ncategories:<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li><strong>Medical Devices\nthat cannot be advertised to the general public<\/strong>, such as devices sold or adapted solely in prosthesis laboratories and\nhearing aid centres and products used or applied exclusively by healthcare professionals.<p><\/p><\/li><li><strong>Medical Devices\nthat can be advertised directly to the consumer<\/strong>, such as cotton wool, adhesive bandages and mouthwash.<p><\/p><\/li><li><strong>Medical Devices\nthat do not fall into the previous categories, <\/strong>such as products that can only be advertised through the platform in\nwhich they are sold. These products cannot be promoted in any other platform.<\/li><\/ol>\n\n\n\n<p>If their advertisement does not conform to the relevant requirements, the sales centres <strong>will be warned<\/strong> and if they do not remedy the breach within 3 days following the Agency\u2019s warning, their activities will be <strong>suspended<\/strong> for 15 days. If during the temporary suspension the centres will carry on its normal activity, their authorization certificate can be cancelled.<\/p>\n\n\n\n<p>In accordance with the measurements undertaken to face Covid-19 Emergency, the Turkish Ministry of Health has authority to make <strong>exceptions<\/strong> for sales centres whose function is that of protection of public health in case of epidemics,
